At Back2Fitness, we are committed to protecting your privacy and ensuring that your personal information is handled in a safe and responsible manner. This Privacy Policy outlines how we collect, use, disclose, and protect your personal information in compliance with the latest privacy regulations.
- Your Monthly Membership Fee will be billed beginning on the Start Date and on the same day of each month thereafter until you cancel in accordance with this agreement. The gym reserves the right to adjust the monthly membership fee with prior notice to the Member.
- Your account will be billed for a minimum of 12 months except all prepaid membership and personal training plans, and will continue on a month-to- month basis at the monthly rate above until you cancel in accordance with the terms of this agreement. if the member cancels before the end of this term, they may be subject to additional fees.
- The Sign Up fee of your gym membership will be charged in conjunction with initial payment as per the membership plan effective from the start date of your membership agreement.
- Your Monthly Membership Fee is guaranteed so long as you remain a member in good standing, including payment of all monthly dues agreement. This applies to all membership plans.
- To cancel your monthly membership and stop the billing of the Monthly Membership Fee, the gym must receive written notification delivered to the gym at least 30 days prior to the monthly payment date either in person or preferably via certified mail to the Back2fitness Inc. Please note that it may take up to seven (7) business days for any membership or billing changes to take effect. Cancellation requests must be processed within a reasonable time frame, and any outstanding dues or fees must be settled before cancellation is finalized.
- If you wish to cancel your membership before the end of the term for reasons other than those listed in Section 8 of this agreement, a buyout fee of $150.00 is required to cancel the membership.If you provide us with more than one method of payment, you authorize us to charge any amounts you may owe us including, but not limited to, any membership-related obligations, retail transactions, and online purchases, to any form of payment which you have provided us until such time as you revoke your authorization for that method of payment by written notification delivered to the gym in person or preferably via certified email.
- If your credit or debit card expires, you authorize us to obtain a new expiration date from the member/guardian/financial cosigner, if we choose to do so, and/or to continue billing the card in accordance with the terms of this agreement (whether or not we have obtained a new expiration date). updating payment information is the member’s responsibility to ensure uninterrupted billing and accrual of charges.
- In accordance with applicable law, if our first attempt to collect any fee under this agreement is unsuccessful, we may make additional attempts to collect from any/all payment methods you provide us, and a service fee of up to the maximum amount allowed by law may be applied for each instance we submit or re-submit such payment request and it is returned uncollectable for any reason including, but not limited to, insufficient funds, expired or canceled payment cards, overdrafts and closed accounts.
- Cancellation & Billing Policies: I have read and understand the cancellation rights and billing policies on the front and back of this agreement. including those policies detailed in Section 8 and the Notice of Cancellation Rights.
By initialing below and signing this agreement, I authorize Back2Fitness Inc. (“Back2Fitness”, “us” or “we”) its assigns, affiliates and other parties authorized by Back2Fitness (collectively “B2F Corporate”) to store the Primary Payment Account and any Alternative Payment Account if applicable, information provided by me on or in relation to this agreement and/or my Back2Fitness membership as well as any other account or card information provided by me through any means to Back2Fitness or B2F Corporate (including any information provided in person, online or over the phone) for purposes of making any payment in relation to this agreement and/or my Back2Fitness membership (hereinafter “Payment Information”). I authorize B2F Corporate to initiate transfers from the Primary Payment Account designated above for the purpose of billing all or a portion of the recurring Monthly Membership Fee I owe to Back2Fitness, – listed in this contract on or around biweekly or monthly basis from the start date, as applicable based on the membership selected. of each month and the Annual Membership on or around the date indicated above until all of my obligations are paid under this agreement. I understand that my obligation under this agreement includes the Monthly Membership Fee, Maintenance Fee, Service fees for uncollectible monthly dues, applicable taxes, charges and any other unpaid fees or dues that are or will become due. I also understand that the Alternative Payment Account, if applicable, may be used by Back2Fitness or B2F Corporate to bill any purchases and incidental charges that I may make, including retail transactions and/or online purchases initiated by me. If at any time Back2Fitness or B2F Corporate is/are unable to successfully bill the primary Payment Account for any fee or other obligation mentioned above, I further agree that Back2Fitness or B2F Corporate may resubmit the fee to the Primary Payment Account and/or bill the Alternative Payment Account if applicable, for any fee or obligation (including service charges), or any portion thereof. This authorization to store and use Payment information will not expire unless it is expressly revoked by me. If my membership will automatically renew at the end of a term set forth in this agreement, the stored payment information will be used to process payments owing in relation to the renewal term. I understand that an email notifying me of such changes will be sent to the e-mail address provided by me on the first page of this agreement.
Cosigner Authorization & Waiver
-[ ] Parent/Guardian : Back2Fitness does not accept members under the age of thirteen (13). In exchange for Back2Fitness allowing my minor child who is thirteen (13) years or older to purchase a membership, I agree to the Release of Liability, Indemnification, and Assumption of Risk clauses in this agreement. Furthermore, I agree to defend, indemnify, and hold harmless Back2Fitness and its parents, subsidiaries, and affiliates to the fullest extent permitted by law for any claim brought by my minor child. I also pledge to assume responsibility for any financial obligations that my minor child fails to fulfill for any reason and acknowledge that the payment information provided above belongs to me. Additionally, I understand and agree that if my minor child is under the age of sixteen (16), he or she must be accompanied by a parent or guardian at all times while at any Back2Fitness facility.
[ ] Financial Cosigner: I promise to pay any financial obligation that the member does not fulfill for any reason and acknowledge that the payment account information provided above accurately identifies my accounts. Furthermore, I agree to defend, indemnify, and hold harmless Back2Fitness and its parents, subsidiaries, and affiliates to the fullest extent permitted by law for any claim brought by the member.
I understand and expressly agree that my use of this Back2Fitness facility involves the risk of injury to me or my guests, whether caused by me or not. I acknowledge that these risks are inherent in physical activity, and my use of the facilities may result in minor injuries to major injuries,including death. In consideration of my participation in the activities and use of the facilities, exercise equipment, and services offered by Back2Fitness, as well as the use by my guests, if applicable, I understand and voluntarily accept full responsibility on my behalf and on my guest’s behalf for the risk of injury or loss arising out of or related to our use of the facilities. This includes, without limitation, exercise equipment, tanning, massage beds/chairs, participation in personal training or other exercise programs, or use of other services, equipment, and/or programs offered to members.
Furthermore, I agree that Back2Fitness and its parents, subsidiaries, affiliates, and associated individuals will not be liable for any injury, including personal, bodily, or mental injury, disability, death, economic loss, or any damage resulting from negligent conduct or omission, whether related to exercise or not. Accordingly, to the fullest extent permitted by law, I hereby forever release, waive, and discharge Back2Fitness and its related entities from any and all claims, demands, injuries, damages, actions, or causes of action related to my use or my guest’s use of the facility against Back2Fitness or anyone acting on its behalf. I also agree to defend, indemnify, and hold harmless Back2Fitness and its related entities from and against any such claims, including those made by my guests.
Additionally, I understand and acknowledge that Back2Fitness and its related entities do not manufacture fitness or other equipment or products available in their facilities and therefore make no warranties and will not be held liable for defective equipment or products. I understand that I am not obligated to sign this agreement if there are any unfilled blanks. I understand my right of cancellation and the billing and refund policies. I acknowledge my release of liability, assumption of risk, and agreement to indemnify, defend, and hold harmless. I have been given the opportunity to review and ask questions related to my use of the facilities, exercise equipment, tanning, massage beds/chairs, and other equipment, as well as my participation in exercise programs or other services and programs offered to members.
Moreover, I agree to comply with Back2Fitness’ membership policies and gym rules that may be communicated to me from time to time, whether in writing, electronically, through gym signage, or verbally. Back2Fitness reserves the right, in its sole discretion, to modify any policy or gym rule at any time and from time to time without advance notice. Back2Fitness also reserves the right to terminate my membership immediately for any violation of membership policy or gym rule. Members are liable to pay up-to $250, if found responsible for damaging the facility or the gym equipment.
NOTICE TO BUYER: THE FOLLOWING PAGE CONTAINS IMPORTANT INFORMATION REGARDING YOUR RIGHTS UNDER THE CONSUMER PROTECTION AND BUSINESS PRACTICES ACT. DO NOT SIGN THIS CONTRACT UNTIL YOU HAVE READ ALL OF IT AND IT IS COMPLETELY FILLED OUT.PLEASE READ AND UNDERSTAND THIS AGREEMENT BEFORE SIGNING.
1. Parties
Back2Fitness (as previously defined) and you agree that by signing this agreement, you are purchasing a membership or services and agree to all the terms contained in this agreement. The terms “you” and “Back2Fitness” include heirs, estates, agents, representatives, officers, directors, shareholders, managers, members, successors, affiliates, parents, subsidiaries and employees. Both parties make this agreement on behalf of, and it binds, all these included persons and entities. It is your responsibility to notify Back2Fitness of any change in your mailing address, billing information or contact information.
2. Representations
A) Physical Condition & No Medical Advice: You affirm that you are in good physical condition and have no medical condition or impairment that could hinder your intended use of Back2Fitness’ facilities. You acknowledge that Back2Fitness did not provide you with medical advice prior to your membership and is not able to offer medical advice after you become a member. Back2Fitness does not offer advice concerning members’ physical conditions or their ability to utilize the facilities. Therefore, if you have any health or medical concerns, whether presently or after joining, it is recommended that you consult with your physician before using the facilities.
B) Liability for Property: Back2Fitness assumes no liability for any personal property belonging to you or your guests that may be damaged, lost, or stolen while on or around Back2Fitness’ premises, including but not limited to vehicles or their contents, or any items stored in lockers. In the event that you or your guests cause any damage to Back2Fitness’ facilities, you are responsible for reimbursing Back2Fitness for the costs associated with repair or replacement.
C) Entire Agreement & Enforcement: You acknowledge that neither Back2Fitness nor any other party made any representations or promises to you that are not explicitly stated in this agreement or any applicable rider. This document, along with any applicable rider, constitutes the entire agreement between you and Back2Fitness, superseding any prior oral or written agreements. If any part of this agreement is deemed invalid by a court, the remaining provisions will remain in full force and effect. Failure by Back2Fitness to enforce any provision of this agreement does not constitute a waiver of its right to enforce such provision in the future. You agree that both physical and electronic copies of this agreement are valid and authentic, and that such copies hold the same legal weight as the original signed agreement.
3. Membership
A) General: Your membership entitles you to access Back2Fitness’ facilities, equipment, and services, and your dues are payable
C1) Membership Freeze (Medical Reasons): Your membership may be frozen for verified medical reasons, such as illness, injury, or medical conditions, upon presentation of appropriate documentation. The freeze period will be determined by your physician and is limited to a maximum of three (3) months. Upon the conclusion of the freeze period, your monthly dues will automatically resume and be billed to the account on file with Back2Fitness unless you choose to cancel your membership or are approved for an extended freeze. Please note that you will continue to be billed for your Maintenance Fee during the freeze period, regardless of the status of your account.
C2) Membership Freeze (Other Reasons): Back2Fitness reserves the right to freeze your membership for other reasons at its sole discretion, such as extended travel or other circumstances requiring absence for a minimum of one month. In such cases, you must provide Back2Fitness with not less than one month’s prior notice. Upon approval from Back2Fitness, your monthly dues will automatically resume at the conclusion of the approved freeze period and will be billed to the account on file unless you choose to cancel your recurring membership or are approved for a longer freeze. Please note that you will remain responsible for your Annual Membership Fee even during the freeze period.
D) Non-Discrimination: Back2Fitness upholds a policy of non-discrimination, ensuring that no individual is discriminated against on the basis of race, national origin, ancestry, color, creed, religion, sex, sexual orientation, age, or disability.
E) Changes to Membership Agreement: Back2Fitness reserves the right to modify this agreement from time to time, except for your guaranteed Monthly Membership Fee. Notice of any material changes will be provided, and upon request, a copy of the revised agreement will be furnished to you free of charge. These revisions will become effective thirty (30) days after such notice, and your continued use of Back2Fitness’ facilities and services constitutes acceptance of these changes
F) Dispute Resolution: In the event that informal resolution attempts fail, both parties agree to resolve disputes through mediation before pursuing formal legal action. Mediation will be conducted on an individual basis in the greater Vancouver area by a qualified independent mediator selected by Back2Fitness.
G) Auto-Renewal Program: Subject to eligibility requirements and compliance with the terms and conditions of this agreement, your recurring membership will automatically renew on a month-to-month basis at prevailing rates, unless otherwise specified by Back2Fitness policy. Renewal terms may be canceled with written notice delivered to Back2Fitness via email no sooner than 60 days prior to the anniversary date of the original contract and at least 30 days before the fulfillment of the original term. Automatic renewal rates are guaranteed provided eligibility criteria continue to be me. Regardless of whether you utilize the facilities. Your membership is subject to all current policies, rules, terms, conditions, and limitations, including but not limited to transferability rules, guest privilege rules, and dress code regulations. It is important to note that your membership grants you no ownership rights in Back2Fitness, its management, ownership, property, or operations. Back2Fitness reserves the right to assign or transfer your membership at its sole discretion, while you have no right to assign your membership or this agreement. Additionally, Back2Fitness reserves the right to sell memberships at different rates and terms than those outlined in your agreement.
H) Group Fitness Instruction: Back2Fitness may offer pre-scheduled group fitness instruction periodically. The capacity for participants in group sessions may be limited, and access to these sessions will be available either by appointment or on a “first come, first served” basis. It is important to understand that these classes serve strictly as informational and instructional sessions and are not intended to substitute personal training. Unilateral right to terminate your membership immediately for any violation of membership policies or gym rules, at its sole discretion.
I) MAINTENANCE FEES: The purpose of the Maintenance fee is to provide for the maintenance and improvement of the equipment and services offered. A $50 maintenance fee is applicable to all the prepaid and recurring membership plans and will be billed to the members Primary Payment Account or Alternative payment account if applicable. Maintenance fee will be charged at the end of three (3) months post membership activation.
4. Dress Code
Back2Fitness is committed to maintaining a safe and comfortable environment for all members. To uphold this commitment, Back2Fitness management and staff reserve the right to enforce a dress code throughout the gym premises. You agree to adhere to this dress code policy. Attire that could be construed as intimidating, revealing, or offensive, as well as clothing that may pose a safety risk or damage equipment, is strictly prohibited.
5. Facilities & Services
A) Back2Fitness retains the right to modify, repair, or replace equipment accessible to members at any time, with no impact on this agreement. Additionally, Back2Fitness reserves the authority to adjust the types or quantities of equipment, programs, or services provided to members, as well as to modify operating hours, at its sole discretion. You acknowledge and consent that the equipment, programs, and services currently available at the facility may change periodically and are offered on a “first come, first served” basis.
B) Back2Fitness routinely closes its facilities or certain sections thereof for temporary maintenance and also observes closures on designated holidays, among other occasions. Members will be informed in advance about this. Such temporary closures will not affect this agreement provided they are reasonable in duration and frequency.
6. Dues, Fees, Charges & Taxes
A) Payment Authorization: You retain complete control over the payment authorization and can terminate it at any time by informing Back2Fitness in accordance with the instructions provided on the front page of this agreement. It is your responsibility to promptly notify your bank or credit card company of any discrepancies appearing on your statement. Any alleged errors on your statement must be reported to Back2Fitness within fifteen (15) days.
B) Charges & Taxes: Back2Fitness reserves the right to augment your prepaid dues, monthly dues, or annual dues with any applicable government-imposed taxes, as well as any utility charges or surcharges associated with the facility.
PRIVACY POLICY
For the purpose of identification at the time of sign-up, valid identification will be collected and stored in the system of records. Back2Fitness reserves the right to contact members if their IDs are nearing expiration, are found to be invalid, or were not provided during sign-up. For record keeping please refer to our Privacy Policy.
7. Limitation of Liability
Unless controlling legal authority requires otherwise, any award by an arbitrator or a court is limited to actual compensatory damages. Specifically, neither an arbitrator nor a court can award either party any indirect, special, incidental, consequential, or punitive damages, even if one party informed the other party that they might suffer these Damages.
8. NO REFUNDS
A. All payments made if you cancel this agreement within 2 days (48 hours) following the date you receive a copy of this agreement.
B.The pro rata cost of any unexpired services (less a prescribed amount) within 48 hours after notice of cancellation is given if (1) you are unable to use Back2Fitness by reason of death, or physical, medical or mental disability, substantiated in writing by a medical practitioner or nurse practitioner, showing that your continued Consumers will not be entitled to a refund once the agreement is signed and firm. They are required to abide by the contract and provide 30 days’ notice for cancellation, if needed. A cancellation fee worth $150 will apply in all scenarios unless its prepaid plan.
9 PERSONAL TRAINING SESSIONS:
All Personal Training Sessions offered under the respective plans are valid for 30 days only. Any unused sessions cannot be carried forward to the following month.
10. Notice of BC Statutory Cancellation Rights.
Your Rights Under the BC Business Practices and Consumer Protection Act: As a buyer, you have the following rights. You have rights to cancel if there has been a “material change” (as defined in the BC Business Practices and Consumer Protection Act) in your circumstances or in the services provided by Back2Fitness.You may cancel this contract at any time during the period that ends two (2) days after you receive a written copy of the agreement. You do not need to give Back2Fitness a reason for canceling during this 2-day period. You may also cancel this agreement at any time by giving notice and reasons if there has been a “material change” (as defined in the Business Practices and Consumer Protection Act) in your circumstances or in Back2Fitness’s circumstances. To cancel this agreement, you must give notice of cancellation to Back2Fitness INC, by any other means that allows you to prove the date on which you gave notice. If no address is set out in the agreement, use any address of Back2Fitness that is on record with the Government of British Columbia or the Government of Canada or is known by you. If you cancel this agreement, the supplier has thirty (30) days to refund all money received, without deduction except as allowed by law (although partial refunds are permitted if the agreement is canceled because of a “material change”).
ADDITIONAL TERMS AND CONDITIONS
NOTICE: ANY HOLDER OF THIS AGREEMENT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF, RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER. MEMBER OBLIGATIONS:
1)You agree to abide by all Back2Fitness policies, follow the directions of the staff regarding safety and security issues, and to treat the staff and Other members with courtesy.
2) You agree to pay monthly dues on time, including notifying Back2Fitness promptly if banking or credit card information used for automatic payment changes, or to be charged a declined payment fee and/or a late fee per delinquent payment.
3) You agree to pay 24% per annum or 2% per month interest on any outstanding amounts owed, and all costs of collection incurred by the holder of this agreement if this account becomes more than 60 days past due.
4) You agree to continue to fulfill the financial obligation of this agreement.
SUMMARY OF MEMBERSHIP POLICIES
1. By executing this Agreement, you hereby join Back2Fitness, and such membership entitles you to use the facilities. You are entitled to use the facility only and shall be required to provide your own athletic equipment and clothes. Additional charges, including but not limited to, the use of tanning beds, or any services if applicable may apply. You may also be charged for purchases through the use of your Primary Account.
2. Upon entering Back2Fitness, you must present proof of your membership. Access to Back2Fitness may be denied without proof of membership and mobile app with access.
3. You agree to abide by all membership regulations of Back2Fitness, including stated and customary rules for participation and use of equipment. You will be responsible for all payments due and owing under this Agreement unless canceled as provided herein. Liability for fees will terminate in the event of death or disability, and in the event of temporary unavailability of facilities due to circumstances such as fire, flood, or loss of lease.
4. Violation of this Agreement or facility rules may result in the suspension of facility use until reasonable assurance of future compliance is provided. During any suspension, no credit for prepayment of dues or fees will be provided. Continued violation may lead to termination of membership and immediate payment of the contract balance.
5. Commercial or business activities are prohibited while using the facilities. Acting as a trainer for other members or guests is strictly forbidden and may result in immediate membership cancellation.
6. You agree to abide by Back2Fitness dress code at all times while in the facility. Flip-flops or bare feet are not allowed, and certain clothing items such as blue jeans with seams or rivets are prohibited.
7. Use of loud or profane language, as well as harassment of other members, guests, or employees, is prohibited. Engaging in such behavior may result in immediate membership cancellation.
8. Use of drugs or steroids on Back2Fitness premises is prohibited. You acknowledge the serious health risks associated with steroids and agree to comply with this policy.
9. Failure to use Back2Fitness facilities does not release you from the obligation to make all required payments under this Agreement.
10. In the event of a violation of this Agreement, Back2Fitness may recover all costs and expenses resulting from legal action, including attorney’s fees.
11. This Agreement contains the entire understanding between the parties and supersedes any prior agreements, whether written or oral. 12. This Agreement may not be amended or modified except by a written instrument executed by both parties.
13. You authorize Back2Fitness and B2F Corporate to contact you by email, telephone, or other means. Consent to contact extends to any provided contact information and is not conditioned upon purchase.
14. Back2Fitness retains the right to modify policies without warning. Members are subject to strict compliance with posted rules and regulations.
15. Utilization of vending machines or purchase of products directly from Back2Fitness may result in the cost being added to the next monthly draft, including Sales Tax, in addition to membership dues.
SAFETY NOTICES
i. This facility is under 24-hour recorded video surveillance, which may be retained by Back2Fitness for subsequent review, and member access card usage is logged.
ii. Guests are not permitted without prior written consent from facility staff. Violation of this policy may result in guest fees, membership suspension or cancellation, immediate payment of the contract balance, and a penalty of up to $250.00, at the discretion of facility management. Mobile app access should not be shared, and lost or stolen fob should be reported to Back2Fitness immediately.
iii. Members without mobile app access will not be admitted during non-staffed hours except in some cases Back2Fitness might provide a fob which can be used to access the gym.
iv. Personal training services may be provided by Back2Fitness employees or independent contractors. All payments for personal training services are to be made to Back2Fitness. Personal training sessions are valid for 30 days only and cannot be carried forward to the next month.
v. Free orientation to the facility and equipment use is available upon request.
vi. Members are responsible for wiping down equipment after each use and re-racking weights.
vii. Safety features of equipment must be used, and instructions should be obtained from staff or personal trainers if unsure.
viii. Members agree to use panic alarms only in case of an emergency.
ix. Inappropriate behavior such as horseplay, vulgar language, or working out while intoxicated may result in membership suspension or cancellation, immediate payment of the contract balance, and penalties.
x. Persons under the age of 13 are not permitted in Back2Fitness
PHOTO APPROVAL
You acknowledge that you may be photographed at Back2Fitness premises. By signing this Agreement, you consent to the use of your photo, video, or film likeness for any legitimate purpose by Back2Fitness, B2F Corporate, and their respective producers, sponsors, organizers, and/or assigns, at their discretion. You understand that by signing this Agreement, you waive all claims of ownership, income, editorial content, and use of such media, and transfer all copyright ownership to Back2Fitness Inc. The Back2Fitness® platform serves as the official wellness community for Back2Fitness® members, primarily accessible through the Back2Fitness® suite of mobile applications, downloadable on Android or iPhone devices. You understand and agree that your use of the Back2Fitness® website at www.back2fitness.ca and the Back2Fitness® platform is subject to the Back2Fitness® Terms of Use. Back2Fitness Inc. reserves the right to modify the terms of the Terms of Use and Privacy Policy at any time without notice to members.
PRIVACY POLICY:I have read and agreed to the Terms & Conditions, the Consent to Electronic Delivery of Documents, the Privacy Policy and certify that this account will not be used by or on behalf of a third party. By signing below, I acknowledge and agree to all the terms contained on the front and back of this agreement. Additionally, I agree to receive commercial electronic messages from Back2Fitness and its partners.
